Constitutional Crisis — NOT!

An opinion writer at the River Falls Journal thinks he or she knows what a Constitutional crisis is. After reading the opinion piece, it is evident he or she doesn't. I will provide facts to prove this author was wrong.
The legislative branch makes the laws and appropriates the funds. Congress established the National Emergencies Act (NEA) ( Pub.L. 94—412, 90 Stat. 1255, enacted Sept. 14, 1976). The Act empowers the President to activate special powers during a crisis (unusual and extraordinary threat to our national security). Consequently, the President has the authority to declare an emergency and it is NOT a violation of the Constitution. Along with the NEA, President Trump has authority to use the Military Construction Codification Act of 1982 which allows for reallocation of funds for military construction projects. Trump is not required to use the military to build the wall but it is an option. Discretion given to the president over how the executive branch is run, or how appropriated money is spent, is merely allowing the head of the executive to exercise his default control over his subordinates. The very first appropriations bill put minimal limits on how the money could be spent outside of the department it was assigned to, and likewise, this authorization by Congress is constitutional.
The executive branch enforces the laws. Several years ago, a government audit found that criminal aliens who were set free instead of being deported at the end of their sentences were being re-arrested as many as six more times by American authorities [investigated 100 aliens — 73 rearrested (429 total) on 878 different charges].
The judicial branch interprets the laws. The Supreme Court will have no choice but to uphold the law as written.
This IS NOT about securing our borders but about WHO wants to secure our borders. In 2006, several democrats voted for the Secure Fence Act (SFA) along the U.S. southern border
There you have it. The truth. Let's try and stick with that River Falls Journal. Next time, I'll fill you in on the REAL Constitution Crisis we are facing as a nation.
