The 30-year-old Benjamin, of Menomonee Falls, was charged with first-degree intentional homicide. He's due back in court Jan. 3, when a judge will decide if there's enough evidence to order a trial.

Prosecutors quoted Benjamin Sebena as saying that he was stalking his wife for days. And he waited for hours during her work shift early Christmas Eve morning, before she emerged from a break at the downtown Wauwatosa fire station.

He's quoted in the complaint as saying that he shot Jennifer in the back of the head with his own handgun, and then shot her several times in the face with her police revolver.

Benjamin Sebena was a Marine who was part of the original invasion force at the start of the Iraq War in 2003. He returned the next year when he was wounded.

Jennifer was a Wauwatosa police officer for almost two years. Her funeral will be on Saturday in Brookfield.
